Terms and Conditions for Scratch & Win

1. Acceptance of Terms By installing, accessing, or using the Scratch & Win application ("the App") on the Wix platform, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not install or use the App. The App is developed, maintained, and provided by Deniz Uyanık ("the Developer").
2. Description of Service Scratch & Win is a custom element widget designed to detect exit intent and display a customizable modal on the user's Wix website. The App provides tools for site owners to customize text, design, and trigger parameters to capture leads and communicate with their audience.
3. Data Privacy and Processing The App processes visitor interactions (such as mouse movements) locally within the visitor's browser to trigger the exit-intent logic. Any data collected through the App's input fields (such as email subscriptions) is routed directly to the site owner's Wix CRM or designated database. The Developer does not store, intercept, or sell personal data submitted by end-users. As the site owner, you are solely responsible for ensuring your website complies with applicable data protection laws (such as GDPR or CCPA) regarding the collection and use of visitor information.
4. Intellectual Property All rights, title, and interest in and to the App, including its underlying code, design, and logic, are and will remain the exclusive property of the Developer. Installing the App grants you a limited, non-exclusive, non-transferable license to use the App on your Wix website in accordance with your subscription plan.
5. Subscriptions and Payments The App is billed through the Wix App Market. All billing, cancellations, and refunds are handled directly by Wix in accordance with Wix's billing policies. The Developer does not have direct access to your payment information.
6. Disclaimer of Warranties The App is provided on an "AS IS" and "AS AVAILABLE" basis. The Developer makes no representations or warranties of any kind, express or implied, regarding the operation of the App, its compatibility with third-party scripts, or the results obtained from its use.
7. Limitation of Liability To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the App.
8. Governing Law These Terms shall be governed and construed in accordance with the laws of Istanbul, Turkey, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Istanbul.
9. Changes to Terms The Developer reserves the right to modify or replace these Terms at any time. Continued use of the App after any such changes constitutes your acceptance of the new Terms.
